PUBLISHED CASES
I/M/O Irrevocable Trust of John Leondis, (2011 NY Slip Op. 32424U; 2011 N.Y. Misc. LEXIS 4427)
Successfully reformed an irrevocable life-insurance trust containing a second-to-die life insurance policy in order to incorporate necessary administrative provisions that were omitted due to a drafting error. The absence of these provisions would have caused the trust to fail, which would have exposed the clients to significant State and Federal estate taxes.
Biro v. Conde Nast, et al., 42 Media L. Rep. 2596 (S.D.N.Y. 2014), affirmed, 807 F.3d 541 (2d Cir. 2015), cert. denied 136 S.Ct. 2015
Successfully argued for the dismissal of defamation claims alleged against both a corporate client and an individual. The Court found, and the Second Circuit affirmed, that the statements published on the corporate website were protected opinion based upon fully disclosed facts and dismissed the individual due to a lack of personal jurisdiction over an out-of-state defendant.
